WEBSITE PRIVACY POLICY

Effective Date of this Policy is July 15, 2016.

SUMMARY

OVAL Digital, Inc. (“OVAL Digital“, and also “we“, “ours” or “us“) operates the OVAL Digital website located at www.meetoval.com (the “Site“), its mobile optimized version and other sites and domains used from time to time, which are hosted in the United States of America.  The terms ‘you’, ‘your’, and/or ‘yourself’ as used herein refer to you, a user and/or browser of our Site. We want you, our customer, to understand how we collect and use data about your Site visit and usage, including accessing your user account through the Site (specifically the portions of the Site and the OVAL App that require you to register and/or log in to gain access), using the OVAL Digital sensor suite (the “OVAL Sensor”), and using our mobile application (the “OVAL App”). Together, the OVAL App, the OVAL Sensor and our Site constitute our first class “OVAL System”.  This Website Privacy Policy (our “Policy”) below identifies what information the Site and/or the OVAL App collects, and what it is used for. The Policy also incorporates by reference our Terms of Use (our “Terms”) [www.meetoval.com/terms], which together, along with any further guidelines and user manuals, will govern your relationship with OVAL Digital.

We use cookies, which gather certain forms of information from your computer to help us monitor and improve Site usage and performance.  Certain web pages may allow you to voluntarily submit personal information about yourself, your residence, or your business so that we can contact you for services in which you express an interest.  For purposes of providing you access to the OVAL System, we may collect, use, treat, store and disclose “personally identifiable information”, which is information that identifies you.  This may include your name, address, email address, telephone or fax number, IP address, any content you post in the OVAL System, and certain other information, which we explain in more detail below.  You can choose not to provide us with this information, but certain portions of the Site may not be available to you.

We may disclose this information to third parties for their marketing or other business purposes, with or without your prior consent, and we may use third party software and services to assist us with collecting and analyzing information regarding use of the Site.  We may also disclose your information to others for other purposes, particularly if required to do so by law.  The Policy for the Site is set forth below and you should contact support@meetoval.com if you have questions or concerns about the use of your information.

INFORMATION COLLECTION

This Policy applies only to activities we engage in on the Site and does not apply to activities that are “offline” or unrelated to the Site (i.e. activities in your home, office or physical location where the OVAL System is present). You should note that different privacy policies may apply to other parts of OVAL Digital’s web presence – for example, separate privacy policies apply to public web pages, or pages for which an authorized vendor or contractor registers and logs in, and henceforth we invite you to revise them and be aware of their terms, which will govern any relationship thereof.

Anonymous Information.  We may collect two types of information through this Site: anonymous information and personally identifiable information (“PII”).  We collect certain anonymous data regarding the usage of the website.  This information does not personally identify users, by itself or in combination with other information.  We gather it to improve the performance of the Site, to undertake our services, for the betterment of our business practices and to create aggregated databases using such anonymized data.  The anonymous data we collect can include information such as the type of browser you are using, IP address, the pages you view, and the length of your visit to the Site.  We reserve the right to use anonymous data for any purpose and disclose anonymous data to third parties in our sole discretion.

Personally Identifiable Information.  We may also ask you to provide PII on the Site, which may include your name, address, telephone number, fax number, company name, e-mail address and relevant details to better allow you to utilize the OVAL System and other OVAL Digital’s products or services that may result of interest to you.  These details may include whether the location is a business or residence, whether the facility is pre-wired for security, and the square footage, to give some examples but not limiting them.   Certain products or services may require additional information such as video and still-images from your monitoring devices or mobile application, and geolocation information including physical location of your device by using your phone’s gateway and/or satellite, cell phone tower, WiFi signals, or other technologies. This information can be gathered when you send us an e-mail or when you complete the specific web page or mobile application request form.  In all such cases, you will receive a conspicuous notice indicating you whether to elect –or not– to provide us with such PII; but please be aware that certain portions of the Site of functionalities of the OVAL System may not be available to you or we may not be able to respond to your inquiry effectively if you do not provide the PII requested.  If you submit any information to us relating to another person, you represent that you have the authority to do so and to permit us to use the information in accordance with this Web Privacy Policy.

Geolocation Information. The OVAL Sensor is the central point of communication for the OVAL System. The OVAL Sensors connects to your internet router and may have backup capabilities that collect data in connection with an Internet or power outage. In order to improve your experience over time and help troubleshoot any problem you may encounter with the OVAL System, we may record the model and serial number, software version, and technical information of your OVAL Sensor. The OVAL System may be able to determine whether you or the other users of your OVAL System are within the OVAL System location (i.e., whether you or the other users are “at home” or “away”) if your or such users’ mobile devices are connected to the OVAL System via various wireless or wired protocols, and we may collect this information. During setup, the OVAL System may allow you to enable location services and we will collect your location information to retrieve your time zone so that the OVAL System can send you certain time-specific alerts. If you want to deactivate this feature, you can disable location services on your mobile device.

My Account. In order to provide some of the services on the Site, we ask you to provide additional PII regarding your customer account with OVAL Digital.  This additional information may include information about your devices and home or office location, payment or credit card details, service preferences and so forth.  We may use this information to support your customer relationship with OVAL Digital, provide you with the desired services and other legitimate business purposes.  This includes responding to your requests, customizing your experience on the Site, communicating with you about your account, and providing you choices about how to view and manage the products and services that you receive from OVAL Digital. If you wish to cancel your account or request that we no longer use your information to provide you services contact us at support@meetoval.com

Customer Service Correspondence. We and our third party service providers may also collect personal information related to customer service correspondence. This information may include e-mails, internet chats, faxes, or telephone calls directed to our customer service centers. We process this information to provide you with customer services, handle your complaints or disputes, measure and improve our customer services, and to detect and prevent fraud or violations of our legal obligations. We have the right to retain customer service information to carry out our business purposes or to comply with applicable legal obligations.

Surveys and Contests.  We may occasionally request information from you via surveys or contests.  Your participation in these surveys or contests is completely voluntary.  The information that we request typically includes your contact details.  If you choose to participate, the information that you provide will be shared with the contest/survey sponsors to notify winners and award prizes.  Survey information may also be used to monitor and improve the content and performance of the Site.

ONLINE ACTIVITY AND TRACKING

Like many websites, the Site employs technologies such as cookies and web beacons (also known as clear GIFs) to automatically receive and store certain information about your use of the Site. We use this information to permit the Site to function properly, to evaluate how you use the Site, to determine where you are located, and to support website analytics and our marketing efforts.

Use of Cookies. Cookies refer to small bits of data that are based on your internet activity and stored as text files by your internet browser on your computer’s hard drive. Through the use of cookies, we may collect information about your location and your online activity on the Site, such as the specific web pages that you visit, the links you click, and the activities you perform on the Site. When you visit other websites where we advertise, we or a third party may use data collected on the Site to show you interest-based advertisements, also called remarketing codes. These type of advertising seems to follow you over the web, and you can also deactivate it just as with cookies. Although most internet browsers are initially set to accept cookies, you can generally find a “help” section on the browser toolbar that will inform you how to stop accepting cookies, to be notified when you receive a browser cookie, and to disable existing browser cookies. However, without browser cookies you will be unable to take advantage of all the features that the Site has to offer.

Use of Web Beacons. Web beacons are tiny graphics embedded on a website that allow the website to transfer or collect information through a graphic image request. We may use web beacons to collect information about your web browsing activities to help us determine if a particular webpage on the Site has been visited, and, if so, how many times. This information permits us or third parties to deliver interest-based advertisements, measure the overall effectiveness of our online advertising, to customize the services offered to the Site’s users, and for other legitimate business purposes.

These web beacons are provided by our ad management partners who may include Google Analytics, Omniture, and other companies. These files enable Google Analytics and Omniture (including remarketing codes) to recognize a unique cookie on your web browser, which in turn enables us to learn which advertisements bring users to our web site. The cookie on your web browser was placed by OVAL Digital, or by another advertiser who works with Google Analytics. With both cookies and web beacon technology, the information that we collect and share is anonymous and not personally identifiable. It does not contain your name, address, telephone number, or email address.

Advertising, Opt-Out. You may opt-out of providing your personal information to the OVAL System at any time by uninstalling the OVAL App. Our marketing emails tell you how to “opt-out.” If you opt out, we may still send you non-marketing emails, such as account notices, important corporate updates. You may send requests about personal information to our Contact Information below. You can request to change contact choices, opt-out of our sharing with others, and review, update, correct, or delete your personal information. We will use commercially reasonable efforts to honor your request. We may retain an archived copy of your records as required by law or for legitimate business purposes. You can typically remove and reject Cookies with your browser settings. Many browsers are set to accept Cookies until you change your settings. If you remove or reject our Cookies, it could affect how our Site works for you. If you do not wish to receive advertising from us, now or in the future, you may opt-out by browsing Google’s opt-out page currently located at www.google.com and following any instructions therein. You can also use the Network Advertising Initiative website currently located at www.networkadvertising.org and following any instructions therein. You can also set preferences for how Google advertises to you and even blocking some ads permanently, by using a tools such as the browser plug-in located at Google. Our ads do not collect any sensitive personal data about you.

You will usually be able to control opt-out mechanisms in the ‘your account’ section of the Site. Lastly, if you use our services through a mobile device, you may also use your device’s settings for control items such as your location sharing, tailored advertising and other privacy settings.

Social Media Features.  Our website includes social media features (e.g. social media message boards, blogs, and forums, the Facebook like button and widgets, the share this button or interactive mini-programs that run on our Site). These social media features may allow to impellent single sign on the Site using your social media account credentials, may collect your IP address, which page you are visiting on our site, and may set a cookie to enable the feature to function properly. Social media features and widgets are either hosted by a third party or hosted directly on our Site. Your interactions with these features are governed by their terms of use and privacy policies, of which you ought to be aware of.

Newsletters. Our newsletters are available to both public users and registered members, who may subscribe or unsubscribe from optional newsletters under their account settings, or by following the unsubscribe links contained in the newsletter emails. As a practical matter, we must release your mailing address to a postal or courier service to deliver information you requested.  Under the Controlling the Assault of Non-Solicited Pornography and Marketing Act of 2003 (‘CAN-SPAM Act’), we will offer free opt-out mechanisms in every commercial request we sent to our users. If you decide — at any time — that you no longer wish to receive such communications from us, please use the unsubscribe instructions provided in any email or communication you receive from us and/or our partners, or by contacting us directly at support@meetoval.com.

USE AND CONTROL OF INFORMATION

As used herein, the terms “use”, “collect”, “treat”, “process” and “disclose”, when related to personal information and other data, include, among other items, use of cookies inside a computer, and statistical and analytical complication thereof for the creation of aggregate databases and marketing strategies; also including but not limiting, the storage, use, combination, integration, disclose, process and transfer of such personal information within our affiliates or other third parties.

Uses by OVAL Digital. OVAL Digital uses the personal information you provide through the Site in a manner that is consistent with this Policy. We use your information for our business purposes. Your information may be shared with other companies to deliver or enhance our Site and services that we provide to you. If you provide personal information for a certain reason, we may use it in connection with the reason for which it was provided and for legitimate business purpose in connection with the reason it was provided.  For instance, if you contact us by email, we may use the personal information you provide to answer your question or resolve your problem.  We use the information collected through the Site for statistical purposes and for improving the Site, as well as for our marketing purposes and potentially sending commercial emails to you.  We may engage a third party’s software or services to assist us with these collections and analyses.

Control of information. We continuously try to improve our user experience, and to give you the best choices for providing, editing or removing certain PII collected by us from you, as well as choice over how we contact you. Generally, you will be able to select the amount and type of information you provide to us when using our Site, usually in the settings section of your account.

Sensitive Data. From time to time, we may collect sensitive personally identifiable about you. For purposes of this Policy, “sensitive personal data” shall mean, including but without limitation, your credit card, biometric data (e.g. fingerprint) and financial data like your bank information. You can rest assured that we undertake all necessary industry standard safety measures to safeguard your sensible PII.

INFORMATION RELEASE AND DISCLOSURE

We will not sell any of your information to any third party, and we shall take commercially reasonable steps to maintain the security of your information. We use industry standard security measures to protect your information from unauthorized access, including secure hardware and software. Notwithstanding the foregoing, we hereby reserve the right to disclose your information when we reasonably believe you to be in breach of our Terms and/or Policy. We will also release any and all collected information and/or personal data under the following circumstances:

  • If required by applicable law;
  • In response to a valid request from a law enforcement agency;
  • To defend ourselves and our affiliates from legal claims by third parties and to respond to such claims and legal processes (including takedown notices and subpoenas);
  • To protect the property, rights and integrity of OVAL Digital or any third party;
  • To prevent or terminate any activity we may consider to be — or which me may consider posing a risk — of any illegal, unethical or objectionable activity;
  • To provide, understand, and improve our Services, via our affiliate, subsidiary or holding companies, which may use your information.

From time to time, we may share our users’ personal information to our authorized third party service providers which perform certain services on our behalf. These services may include, but will not be limited to: community management, customer service, analytics, user engagement, marketing, surveys and other features offered through our Site.

Emergency Services. We may share your information with third party emergency service providers such as police departments, fire departments, insurance companies and emergency medical services, only insofar as we are capable of providing it, and only as it may be required by them. Transfer in the event of sale or change of control. We may transfer your information to a third party in the event of a bankruptcy, reorganization, merger, sale, transfer of the assets or ownership in connection with proposed or consummated corporate reorganizations (e.g. mergers, acquisitions, or sales of business units), joint venture, assignment, transfer or other disposition of all or any portion of our business, assets or stock, including in connection with any bankruptcy or similar proceedings.

Third party services. OVAL Digital may disclose your personal information to our authorized third party service providers and subcontractors, in order to provide you with products and services, process purchase orders that you submit via the Site and to enable you to track the progress of purchase orders. This may include sharing certain data with third party providers such as couriers and providing you access to shipper tracking numbers.  Similarly, if you qualify for any rewards based on your purchase history, this information will also be processed by OVAL Digital and our agents to enable your access to these benefits.

If you elect to receive information about third party offers, we may share your personal information with these companies so that they can send you details about their special offers. You should know in advance that each of these companies has its own policies with respect to the collection and use of personal information and that we are not responsible for their use of your information.

INFORMATION SECURITY AND SECURE TRANSACTIONS

We have implemented various security measures for the purpose of protecting your personal information against accidental or unlawful destruction or accidental loss, alteration, unauthorized disclosure or access and against any other unlawful forms of processing.  When you create a user profile and log in to a secure portion of our Site, your personal information benefits from the protections of Secure Sockets Layer (“SSL”) technology.  Our web servers have been enabled with SSL technology to automatically encrypt your information and help prevent unauthorized parties from viewing your account or payment information during a secure session.  This is why you must enter your unique user name and password each time you access your account information online or place a purchase order through the Site.

You are responsible for maintaining the confidentiality of your user name and password.  You are responsible for all uses of your password, whether or not authorized by you.  You must inform us immediately of any unauthorized use or your user name or password.

However, the transmission of data over the internet by its nature entails the use of systems under the control of third parties, and as a result OVAL Digital will work to prevent any violation of the security systems but cannot ensure total control of the security of such systems.

THIRD PARTY WEBSITES

Please be aware that our Sites may contain links to other sites on the internet that are owned and operated by third parties.  Our Site utilizes framing techniques to make it appear that the user is still on the site when the user is actually on a third party website. For example, if you are on a page that has the look and feel of www.meetoval.com or other OVAL Digital, Inc. sites, but the URL listed in the properties of your browser is a different URL, then know that the information is being collected by this third party and their privacy policy governs the collection and use of this information.

The information practices of those websites linked to our Site are not covered by this Policy.  We are not responsible for the privacy policies of websites to which the Site links.  If you provide any information to such third parties, different rules regarding the collection and use of your PII may apply. We strongly suggest you review such third party’s privacy policies before providing any data to them. These other sites may send their own cookies or web beacons to users, collect data or solicit PII.  We cannot control this collection of information. You should contact these entities directly if you have any questions about their use of the information that they collect.

Please take into account that we shall not be responsible for the business practices employed by such third party websites, including the information or content contained thereinto. Please remember that when you use a link to go to another website, our Policy and Terms do not apply to those third-party websites or services. Your browsing and interactions thereof are at your own and final risk. Any banner or advertising of a third party we show on our Site does not constitute and endorsement thereof. Finally, you agree that we are not responsible and do not have control over any third-parties that you authorize to access your personal data and other information.

CHILDREN AND MINORS

OVAL Digital understands the importance of protecting children’s privacy in the interactive online world through the simple use of the Site, you hereby represent that you are at least eighteen (18) years of age –or older– as of the date of first access to the Site. If you are still a minor (this may depend on the jurisdiction where you reside), you represent that you are using the Site under the direct supervision of your parent or legal guardian. In compliance with the terms and conditions of the Children’s Online Privacy Protection Act (‘COPPA’), OVAL Digital does not (knowingly) collect any kind of information from any person under the age of thirteen (13) years. We will delete data associated with any account for which we obtain actual or purported knowledge that the user associated thereon is not at least thirteen (13) years old.

RIGHTS, REVOCATION OF CONSENT

Any user of our Site and services has the right to make a request to us in order to uphold his or her rights to:

  • Access his personal data;
  • Rectify his personal data when inaccurate or incomplete;
  • Cancel his personal data;
  • Object with legitimate reasons the process of his personal data; and/or
  • Revoke his consent for the process of his personal data at any moment, in order to stop its use.

 

The enforcement and upholding of your rights to access, rectify or cancel your personal data and/or object or otherwise revoke your consent should be requested in writing to us and must include, at the least, the following information:

  • Your name, address and e-mail address in order to notify you of the response to your request;
  • Documents establishing your identity; and
  • A clear and concise description of the personal data with regard to which you seek to uphold any of the abovementioned rights (when rectification is requested, modifications to be made should be specified and documentation provided to back up its request).

 

For the exercise of your previous rights, OVAL Digital, Inc. will be our designated agent to receive notification of alleged infringement under the Digital Millennium Copyright Act or DMCA. Upon receipt of proper notification of claimed infringement, OVAL Digital will follow the procedures set forth and in the DMCA. You may remit any DMCA notice to the following e-mail address: support@meetoval.com. Upon your request to us, and after proper review, we may edit, deactivate and/or delete your personal data and other information from our active databases. Please be advised that we may not be able to delete all of your personal data from some of our secure databases and, in such case, we will make the data permanently inaccessible to any third parties. You may also be able to edit the personal information we store about you, by going to your account settings in the Site.

INQUIRIES, CORRECTIONS AND COMPLAINTS

Your data is submitted to OVAL Digital and is hosted and stored in a database on servers situated in the United States of America (‘USA’) and other countries where OVAL Digital and third parties on its behalf operate. Any personal information provided by you to OVAL Digital may be transferred and stored on computers, servers and datacenters located through the globe, that is, outside your county, state, provide and/or city; whose governmental jurisdictions could be less protective that those in your jurisdiction. Our Site is, therefore, subject to applicable USA law. If you are accessing our Service from other jurisdictions, please be advised that you are transferring your personal information to us and, thus, by using our Site, you hereby consent to that transfer of information to the USA or to any other country in which OVAL Digital operates its facilities.

You are responsible for ensuring that the personal information you have submitted or access through the Site is accurate and complete.  You may change the information we have on file for you by accessing My Account and entering any new or different details.  If you have included payment details or credit card information, you may alter these via the appropriate link on your My Account page.  Please contact us immediately if you notice changes to your profile that you did not request or if you notice any suspicious activity concerning your account.
